These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at gerarealty.in (together or individually “Service”). Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages and application.
Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood the Agreements, and agree to be bound by them.

Users agree not to submit any property descriptions, photographs, financial, contact or other information to gerarealty.in unless the User submitting such a Listing/Advertisement has acquired and received all necessary rights and authorizations from the owner of such property or the power-of-attorney holder, including from the photographer and/or copyright owner of any photographs, to publish and advertise the said Property(s).
Gera Realty acts only as a listing platform and does not take ownership of content submitted by Users. Gera Realty does not perform independent verification of listings and assumes no liability for accuracy or legal compliance of user-submitted content.
Users covered under RERA must obtain all requisite approvals, licenses and permits issued by competent authorities with respect to the Project/Land/Apartment/Plot in the listing, and must disclose material information including title, ownership, encumbrances and registration details. Gera Realty may require supporting documents or sworn affidavits and may remove listings which appear to violate these Terms.
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including payment and billing details.
You represent and warrant that: (i) you have the legal right to use any payment method in connection with any Purchase; and (ii) the information you supply is true, correct and complete.
We may use third-party services to process payments. By submitting payment information, you authorize us to provide it to those third parties as necessary and subject to our Privacy Policy. We reserve the right to refuse or cancel any order for reasons including product/service availability, pricing errors, or suspected fraud.
Any contests, sweepstakes or other promotions (“Promotions”) offered through the Service may be governed by separate rules. Participation in Promotions is subject to the applicable Promotion rules in addition to these Terms. In case of a conflict, the Promotion rules prevail.
Some parts of the Service may be billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”) as described at purchase.
Subscriptions auto-renew at the end of each Billing Cycle unless cancelled. You may cancel renewals via your account settings or by contacting info@gerarealty.com. A valid payment method is required to maintain Subscriptions; failure of payment may result in suspension or termination.
Gera Realty may, at its sole discretion, offer free trials of Subscriptions (“Free Trial”). If billing information is required for a Free Trial, you will not be charged until the trial expires. Unless cancelled prior to expiry, the applicable Subscription fees will be charged automatically.
Gera Realty reserves the right to modify or cancel Free Trial offers at any time.
Gera Realty may modify subscription or service fees at any time. Fee changes will apply at the end of the current Billing Cycle. We will provide reasonable prior notice of fee changes; continued use indicates acceptance.
Refunds, if applicable, will be issued subject to our refund policy. Where provided, refunds for Contracts will be processed within 7 days of the original purchase subject to review and deduction of any applicable fees.
Content on this Service (text, graphics, images, logos, etc.) is the property of Gera Realty or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use such Content for commercial purposes without prior written consent from Gera Realty.
You may use the Service only for lawful purposes. You agree not to:

The Service is intended for individuals who are at least eighteen (18) years old. By accessing the Service you represent that you are 18 or older. If you are under 18, you must not use the Service.
When you create an account, you warrant that the information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Gera Realty may suspend or terminate accounts that provide false information or violate these Terms.
The Service and its original content (excluding user-provided content) are owned by Gera Realty and its licensors and protected by applicable intellectual property laws. Trademarks may not be used without prior written consent.
We respect intellectual property rights. If you believe Content on the Service infringes your copyright, please email info@gerarealty.com with a detailed claim. Misrepresentations may result in legal liability for damages.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GERA REALTY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION, CONTENT, OR SERVICES PROVIDED. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GERA REALTY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR LIABILITY, IF ANY, IS LIMITED TO THE AMOUNTS PAID BY YOU FOR THE SERVICES.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. If you wish to terminate your account, discontinue use of the Service. Provisions that by their nature survive termination will remain in effect.
These Terms are governed by the laws of India without regard to conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.
We may withdraw or amend the Service at any time without notice. We are not liable if all or any part of the Service is unavailable at any time or for any period.
We may amend these Terms by posting the revised Terms on this page. It is your responsibility to review these Terms periodically. Continued use after changes constitute acceptance of the updated Terms.
No waiver by Gera Realty of any provision of these Terms shall be deemed a further or continuing waiver. If any provision is deemed invalid, the remaining provisions remain in effect.
